1. Acceptance of Terms

By creating an account or using WaitlistAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. The Service is provided by WaitlistAI.

2. Account Responsibilities

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
• You must be at least 18 years old to use the Service.
• You may not share your account credentials with others or allow unauthorized access to the Service.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws.
• Enter false, misleading, or fraudulent customer data into the system.
• Use the Service to send unsolicited or spam email notifications.
• Attempt to access, modify, or disrupt other users' data or the Service's infrastructure.
• Use the AI Support feature to extract internal system information, prompts, or implementation details.
• Reverse engineer, decompile, or disassemble any part of the Service.

4. Subscription and Billing

• WaitlistAI offers several subscription plans, including Free, Starter, Pro, Pro+, and CommerceFlow. Current pricing is available on the Pricing page.
• Paid plans are billed monthly through Stripe. Payment is due at the beginning of each billing cycle.
• All paid plans offer a 14-day free trial. You may cancel at any time during the trial without being charged.
• You can manage your subscription, including cancellation, through the Billing page or the Stripe Customer Portal.
• Prices are subject to change with reasonable notice. Existing subscribers will be notified of any price changes before they take effect.

5. Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you will retain access until then. We do not automatically issue refunds for partial billing periods. If you believe you were charged in error, please contact our support team through the application.

6. Your Data Responsibilities

You are responsible for the accuracy and legality of all customer and waitlist data you enter into the Service. You must have appropriate consent from your customers to store their information and send them notifications. You are responsible for complying with applicable data protection laws in your jurisdiction. WaitlistAI processes data on your behalf but does not assume responsibility for how you collect or use your customers' information.

7. CommerceFlow

CommerceFlow is an e-commerce product available as a standalone $29/month plan and included with the Business plan. Depending on the features and integrations you use, CommerceFlow provides product waitlists, embeddable "Notify Me" widgets, public product pages, back-in-stock email notifications, product and listing tools, AI-assisted product workflows, demand analytics, order management, fulfillment provider connections and product mappings, dropshipping and print-on-demand workflows, AI Employee automation controls, approval and action workflows, Profit Protection, AI Creative Studio, and Creator Merch tools. You are responsible for ensuring that the products, customer data, orders, fulfillment activity, and notifications you create or send comply with applicable laws and your customers' preferences. CommerceFlow access may be granted through a subscription or an authorized promotional code.

8. AI Support Limitations

Our AI Support assistant provides automated help based on our knowledge base and application documentation. AI responses may not always be accurate or complete. The AI assistant cannot perform account changes, process payments, or modify your data — it can only suggest actions. For complex or sensitive issues, please escalate to our human support team. We are not liable for decisions made based solely on AI-generated responses.

9. Intellectual Property

The Service, including its design, features, and content, is the property of WaitlistAI and is protected by intellectual property laws. You retain ownership of the business and customer data you enter into the Service. You may not copy, modify, or distribute the Service or its components without authorization.

10. Third-Party Services

The Service integrates with third-party services, including Stripe (payments), Google Calendar (scheduling), and Google (authentication). Your use of these services is subject to their respective terms and policies. WaitlistAI is not responsible for the availability or actions of third-party services.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for downtime or data loss resulting from factors outside our reasonable control.

12. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be error-free, secure, or available at all times. You use the Service at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, WaitlistAI shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you have paid for the Service in the twelve (12) months preceding the claim.

14. Termination

You may terminate your account at any time by canceling your subscription and discontinuing use of the Service. We may suspend or terminate your account if you violate these Terms or engage in activity that we determine is harmful to the Service or other users.

15. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by posting a notice in the application or by sending an email. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved in the appropriate courts of the applicable jurisdiction.
